"Seller" means the entity identified above; "Customer" the user who makes a purchase. Where the Customer acts as a "Consumer", the protections of the Italian Consumer Code (Legislative Decree 206/2005) apply.</p> <h2>2. Scope</h2> <p>These General Terms govern the distance sale of clothing and accessories (including hijab and similar) through the Site. Placing an order implies acceptance of these Terms, the <a href="/privacy">Privacy Policy</a> and the <a href="/cookie-policy">Cookie Policy</a>.</p> <h2>3. Products, prices and availability</h2> <p>All <strong>prices are in Euro (&euro;) and include VAT</strong> and any applicable tax. Prices do not include <strong>shipping costs</strong>, which are shown separately and clearly before the order is completed. Product images and descriptions are indicative. Availability is subject to verification; in case of unavailability the Seller will inform the Customer and refund any amounts already paid.</p> <h2>4. Conclusion of the contract</h2> <p>The Customer adds products to the cart and proceeds to checkout providing shipping and billing details. Before submitting, the Customer sees a summary (products, total price incl. VAT, shipping costs, estimated delivery times) and must <strong>expressly accept</strong> these Terms and the Privacy Policy (non-preselected checkbox). The order is placed via the <strong>"Order with obligation to pay"</strong> button (Art. 51(5) Consumer Code). The contract is concluded when the Seller sends the <strong>order confirmation</strong> to the Customer's email.</p> <h2>5. Payments</h2> <p>Payment is made via <strong>Stripe</strong> (credit/debit cards and supported methods). Payment data are handled directly by Stripe in a secure environment; the Seller does not store full card details. Goods are shipped after payment is confirmed.</p> <h2>6. Shipping and delivery</h2> <p>Shipping costs and times are shown at checkout before the order is completed. Unless otherwise agreed, the Seller delivers without undue delay and in any case within <strong>30 days</strong> of conclusion of the contract (Art. 61 Consumer Code). Risk of loss or damage passes to the Consumer upon physical delivery.</p> <h2>7. Right of withdrawal (Consumers) &mdash; Arts. 52-59 Consumer Code</h2> <p>The Consumer has the right to <strong>withdraw within 14 days</strong> without giving any reason. The 14-day period runs from the day the Consumer acquires physical possession of the goods. To withdraw, the Consumer must inform the Seller with an explicit statement (email to Ilvelo_italia@hotmail.com) before the deadline; the model withdrawal form (Annex I-B) may be used but is not mandatory. Goods must be returned without undue delay and within <strong>14 days</strong> of the withdrawal notice to. Il Velo di Karnib Ghadir, Via Berenini 118, 43036 Fidenza (PR), intact and not used beyond what is necessary. Unless otherwise indicated, the <strong>direct cost of returning</strong> the goods is borne by the Consumer. The Seller refunds all payments received, including standard delivery costs, without undue delay and within <strong>14 days</strong> of being informed of the withdrawal, using the same means of payment; the Seller may withhold the refund until the goods are received or proof of return is provided. The Consumer is liable for any diminished value of the goods resulting from handling other than necessary.</p> <p><strong>Exceptions (Art. 59).</strong> withdrawal is excluded, among others, for made-to-measure or clearly personalised goods, and for sealed goods that are not suitable for return for hygiene reasons and were opened after delivery.</p> <h2>8. Legal guarantee of conformity (Consumers) &mdash; Arts. 128-135 Consumer Code</h2> <p>All products are covered by the <strong>24-month legal guarantee of conformity</strong> from delivery. In case of lack of conformity, the Consumer is entitled to have conformity restored (repair or replacement) free of charge or, under the conditions of law, to a price reduction or termination of the contract. Defects appearing within <strong>one year</strong> of delivery are presumed to have existed at delivery, unless proven otherwise. Dispute resolution (ADR) &mdash; Arts. 141 ff. Consumer Code</h2> <p>For any dispute the Customer may contact the Seller for an amicable solution. Failing agreement, the Consumer may use the <strong>alternative dispute resolution (ADR)</strong> bodies listed by the competent authorities (e.g. at the Chambers of Commerce or bodies accredited under Legislative Decree 130/2015). <em>Note. the EU Commission's Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025 and is therefore no longer available.</em></p> <h2>10. Governing law and jurisdiction</h2> <p>Contracts are governed by <strong>Italian law</strong>. For Consumers, the mandatory protective rules and the jurisdiction of the court of the Consumer's place of residence or domicile in Italy remain unaffected.</p> <h2>11. Intellectual property</h2> <p>The Site's content (texts, images, logos, the "il Velo" brand) belongs to the Seller or the respective owners and is protected by copyright and trademark law.
